Οι νομικοί όροι τις περισσότερες φορές δεν αντιστοιχούν σε αντικείμενα με φυσική υπόσταση, αλλά εκφράζουν νομικές έννοιες τις οποίες οι νομικοί μέσα στον χρόνο και σε διαφορετικούς τόπους έχουν αποκαλέσει διαφορετικά. Ποια θα πρέπει να είναι η επίδραση του χωροχρόνου στην νομική ορολογία; Ποια είναι η ‘ορθή’ επιλογή της λεξης όταν μεταφράζουμε από την ελληνική προς την αγγλοσαξονική νομική γλώσσα; Πότε δεν είναι αντιδεοντολογικό να πλησιάσουμε περισσότερο προς τη γλώσσα-στόχο, έστω υποχωρώντας σε κάποιο βαθμό έναντι της δικής μας; Η απάντηση δεν εξαρτάται μόνο από το σημαίνον πρόσωπο του αναγνώστη, αλλά και από την αντίληψη που θα στηρίξουμε ως προς την προστασία της επιλογής της ‘απεικόνισης’ του δικού μας συστήματος.

I recently had the chance to meet with Hellenic Supreme Court Judge, Argyris Stavrakis at a conference in Athens. Stavrakis is the author of “Modern Greek Legal Language and Terminology” (Νεοελληνική Νομική Γλώσσα και Ορολογία) currently in its third edition and available from P. N. Sakkoulas Press in Greek.
